A Scenic Artist was on his first day inside a Queens County warehouse helping paint set walls for a television show. Within 45 minutes of starting his work, two cinderblocks fell off the top of a 10-foot interior wall and struck him directly on the head and shoulder. A 7-year-old girl attending a public school was told she needed speech therapy. The school never informed her parents that they were having a 14-year-old male student supervise their daughter during the speech class. The infant plaintiff was repeatedly molested during 4 separate speech classes by the 14-year-old on her private areas while they sat next to one another in the small classroom with only the teacher and one other young male student present. The male student on the fourth day forced the girl’s hand inside his pants and she pulled free, walked out, and told her parents everything. The police were called and the male student was arrested. A Family Court judge allowed the male student to return to school and dismissed the case without a trial.

A construction worker in Westchester County was struck in the head by a 5-gallon paint bucket being hoisted to the roof above him. Under New York Labor Law §240, the owner of the building was responsible for ensuring workers were protected from falling objects. Brett Nomberg won summary judgment establishing 100 percent liability against the defendants. With liability decided the only issue for trial was how much to award in damages. The defendants and their insurance company then wanted to settle and agreed to pay $875,000 right we picked a jury.

A pedestrian was struck and killed in Brooklyn by a driver of a dump truck while crossing the street inside the crosswalk. After the driver initially stopped he then decided to go through the red light and stuck the plaintiff while making a left turn. A student was pushed off the bleachers by another student inside the school gymnasium during an after-school program breaking her arm that required surgery.
